Questions and guides
What we are asked most about buying, renting, documents and our fees. If your answer is not here, write in the chat or call.
Buying a flat, step by step
Buyers of our listings pay the agency nothing: the seller pays the fee.
How many steps are there and how long does it take?
Viewings, an offer, the document check, the deposit, the notary and registration. For a cash purchase it usually takes 5 to 10 days from deposit to notary; with a mortgage 3 to 5 weeks, while the bank reviews the application and values the flat.
What is the deposit (beh) and how much is it?
The deposit confirms the agreement and counts towards the price. The parties agree the amount, usually 2,000–5,000 ₼. The written deposit agreement states the price, the notary day and when the deposit is returned.
Is the deposit returned if the deal falls through?
Under the Civil Code, if it falls through because of the buyer, the seller keeps the deposit; if because of the seller, they repay double. If a problem turns up in the documents, the deposit is returned in full: we write this into the agreement.
What happens at the notary?
The sale contract is signed and the notary sends the transfer of ownership to the state register. Payment is made by bank transfer or through the notary’s deposit account. A new extract in the buyer’s name is issued within a few working days.
Who pays the notary and registration costs?
Usually the buyer, while the seller pays the tax withheld on the sale. The exact sums depend on the property’s area and zone: before the deal we get a written calculation from the notary and show it to you.
The document check for buyers
Free for our listings. For a property you found elsewhere our lawyer does the same check for ₼150, with a written result in 2 working days.
What do you check?
The registry extract and the owner’s identity, any seizure or mortgage on the property, who is registered as living there, the consent of co-owners, the validity of any power of attorney and utility debts.
What is an extract?
The extract from the State Register of Real Estate is the main document confirming ownership. Older title deeds (kupcha) are still valid, but it is wise to get a fresh extract before a sale.
Can I buy in a new building that has no extract yet?
You can, but the risk is different: the flat is bought on a contract with the developer and a state mortgage is not available. We check the developer’s building permit and its application for the extracts.
Is an altered layout a problem?
A removed wall or a balcony joined to a room no longer matches the plan in the extract. For a cash purchase this is rarely an obstacle, but a mortgage bank may object at the valuation. We tell you about every difference in writing.
Renting
On a rental the tenant pays our fee once. The landlord pays nothing.
What do I pay on moving day?
The first month’s rent, the deposit (usually one month’s rent) and our fee of half a month’s rent. Every rental listing shows this sum worked out.
When is the deposit returned?
In full at the end of the contract, if the flat and its contents are handed back as listed in the inventory. That is why we draw up the inventory with photos on moving day.
What is the shortest rental term?
Most of our listings are let for 6 or 12 months or more. We do not handle daily rentals.
I am a foreigner. Can the contract be in English?
Yes. We prepare the contract in two languages. Registering your place of residence needs the landlord’s documents, and we write that into the contract.
Our fees
A fee is due only when a deal is done.
What is the fee on a sale and who pays it?
The seller pays 2% of the final price, at least ₼2,500. It is paid after ownership has passed to the buyer.
Does the buyer pay a fee?
Not when buying one of our listings. If you ask us to search the market for you (a buyer’s agent), the fee is 1% of the price.
What is the fee on a rental?
For flats and houses the tenant pays half a month’s rent once. For offices and shops the fee is one month’s rent.
Is a valuation paid for?
The online estimate and an agent’s visit are free. The official report of a licensed appraiser for a bank, a notary or a court is paid: 120 ₼ for a flat, 200 ₼ for a house, 250 ₼ for commercial property.
For foreign buyers
Nigar Ahmadova and Tural Asgarov work in English and Russian; Nigar also speaks Turkish.
Can a foreigner buy property in Azerbaijan?
Yes: flats, houses, offices and shops. Under Article 48 of the Land Code foreigners can only lease land; when a house is bought, the land beneath it comes on a lease.
Does property give a right to residence?
Under the Migration Code, owning real estate in Azerbaijan worth at least 100,000 ₼ is one of the grounds for a temporary residence permit. The application includes the extract and a licensed appraiser’s report. Check the current terms with the State Migration Service.
Can I buy without being in the country?
You can: we hold the viewing by video call and your representative signs under a notarised power of attorney. A power of attorney issued abroad is accepted with an apostille or consular legalisation.
In what currency is the payment made?
The contract states the price in manat and payment is made in manat.
