What the Labour Code says about training at work

The Code has no chapter called “training”, but five articles say what a worker and an employer may do. Articles as in the text of October 2026.

The worker’s right

Under article 9 a worker has the right to improve their professional training, learn a new profession and raise their qualification. Article 12 requires equal treatment of men and women in this: who is sent on a course cannot be decided by sex.

The employer’s right

Article 11 gives the employer the right to organise workers’ additional education at additional education providers. So a company may choose a course and pay for it; the fee is invoiced to the company and the worker pays nothing.

Appraisal and training

  • An appraisal takes into account the results of the training a worker had in the last 5 years (article 65). A certificate with the hours and the final score is useful here.
  • After an appraisal the employer may send the worker to training (article 67).

Study leave does not cover courses

The paid study leave in article 123 is for formal education: exam sessions, state exams, a thesis. Short courses get no such leave. If lessons fall in working hours, agree it with your manager in writing; evening or weekend groups are the easiest way.

What a company should ask

  • Are the course’s hours and programme written down by module?
  • What share of lessons must the worker attend, and will the company see attendance? With us it is 80%, and HR gets a report every month.
  • Can the certificate be checked by its number?
